DMCA Notice & Counter-Notice

Orvica responds to notices of alleged copyright infringement consistent with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.

Filing a notice

To file a notice of alleged copyright infringement, send a written communication to our designated agent at dmca@orvica.co that includes:

1. A physical or electronic signature of the owner (or authorized agent) of the right allegedly infringed;
2. Identification of the copyrighted work claimed to have been infringed;
3. Identification of the material claimed to be infringing and information sufficient for us to locate it (URL is ideal);
4. Your name, mailing address, telephone number, and email address;
5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
6. A statement, under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or are authorized to act on behalf of the owner.

Our response

On receipt of a notice that satisfies the above requirements, Orvica may remove or disable access to the material and notify the user who submitted it. We may, in our discretion, terminate accounts of repeat infringers.

Counter-notice

If your material was removed in response to a notice and you believe the removal was a mistake or misidentification, you may file a counter-notice with dmca@orvica.co containing:

1. Your physical or electronic signature;
2. Identification of the material that was removed and its prior location;
3. A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification;
4. Your name, address, and telephone number, plus a statement that you consent to the jurisdiction of federal court for the judicial district in which your address is located (or, if outside the U.S., for any judicial district in which Orvica may be found), and that you will accept service of process from the complainant.

Misrepresentation

Notices and counter-notices submitted under the DMCA may include statements made under penalty of perjury. Knowingly material misrepresentation can result in liability under 17 U.S.C. § 512(f).
